It is previously specified that these Terms of Sales Conditions govern the organization and realization of private tours for small groups (<8 people) and larger groups (> 9 people), the organization of corporate events and team-building activities, ticket sales for individual tours as well as all transfers by coach or minivan, achieved directly by Kanpai Tours or one of its partners.


ARTICLE 1: GENERAL CLAUSE

Any booking made with Kanpai Tourism will be governed by and subject to these Terms & Conditions. Please read the following information carefully. This constitutes a contract between You (the customer) and We (Kanpai Tourisme).

ARTICLE 2: BOOKING CONDITIONS, DEPOSIT & PAYMENT

2.1 For private group tours of more than 8 people, corporate events, team building activities, and coach & minibus transfers, to make a booking, the following steps must be completed:

a) The customer must complete and sign the booking form and send it back to Kanpai Tourism by email or by postmail with the requested details about the group, indicating especially the date, the number of persons and the chosen method of payment.
b) The customer must make a deposit payment to Kanpai Tourism which amount varies according to the number of days remaining between the date of achievement of the tour / service and the date of signature written on the booking form:

- More than 90 days: deposit of 10% of the total amount of the proforma invoice must be paid.
- Between 45 and 89 days: deposit of 20% of the total amount of the proforma invoice must be paid.
- Between 30 and 44 days: deposit of 30% of the total amount of the proforma invoice must be paid.
- Between 15 and 29 days: deposit of 50% of the total amount of the proforma invoice must be paid.
- If the reservation is made less than 15 days before the scheduled date for the tour or service, payment of the total amount is required upon booking.

C) Once Kanpai received the deposit of 10%, 20%, 30%, 50% or the full payment, Kanpai Tourism will issue a confirmation invoice and send it by email to the customer.

Once these 3 conditions are fulfilled, a contract will arise between Kanpai and the client. If payment of the deposit by the customer does not occur within 7 days from the date of signature on the booking form, Kanpai considers that the reservation request is canceled. The customer can pay by bank transfer and credit card. The costs of banking transactions are the responsibility of the customer.

The customer has 14 days upon receipt of the confirmation invoice to inform Kanpai Tourism of any errors or omission. After these 14 days, the invoice is considered as contractual.

2.2 For tickets for individual tours and private tours up to 8 people, full payment is required upon booking whether purchase is made on kanpai’s website www.kanpai-tourisme.com or via a kanpai’s booking form.


ARTICLE 3: PRICES & RATES VALIDITY

3.1 For private group tours of more than 8 people, corporate events, team building activities, and coach & minibus transfers, prices are communicated to the customer through a personalized quote with VAT included These prices are valid for 30 days from the date of the quote sent by Kanpai Tourism.

3.2 For individual tours or private tours of up to 8 people, all prices listed on the Kanpai Tourism website, flyers or advertising posters are inclusive of VAT and are indicative. We reserve the right to change and correct errors in any of the prices, services or other particulars contained in Kanpai brochures, website or advertisements at any time before we enter into a contract with you. Prices are calculated in function of the economical data of the moment. Since we have printed our brochures, prices might change is there is an increase in government taxes, fuel costs, fees at the wineries, etc. Tour prices include transport, visits, guiding and wine tasting. Departure and return time are only indicative because of heavy traffic conditions, in particular in Lyon city. If there is any change or error of which we are aware, we will notify you of this before you enter into such a contract.

3.3 Any activities, items or purchases not included in Kanpai’s programs or the confirmation invoice will be paid by the customers: aperitifs, lunches, coffees, wine bottles, souvenirs, etc.
 

ARTICLE 4: PAYMENT OF THE BALANCE

For private group tours of more than 8 people, corporate events, team building activities, as well as coach and minibus transfers, the customer formally agrees to pay the balance of the invoice 15 days prior the date of service performance. If the final balance is not paid at the scheduled date, Kanpai will consider that you the Customer is cancelling the service. In this case, Kanpai will apply cancellation charges according to the following Kanpai’s cancellation chart stipulated in below article 5.


ARTICLE 5: CANCELLATIONS AND REFUNDS

5.1 Private group tours of more than 8 people, corporate events, team building activities, as well as coach and minibus transfers: any cancellation must be made by sending an email to Kanpai Tourism (kanpai.tours@gmail.com) and also calling by phone kanpai Tourism Offices talking directly to Kanpai Director (+33 684 521 499). Kanpai Tourism will confirm the cancellation to the Customer by sending an email. Cancellation charges will apply which will vary according to the time we receive the email and the phone call notice by the person who signed the booking form.

The percentage is calculated on the basis of the total amount of the confirmation invoice. The cancellation charges are:

- 45 or more days prior to tour date:    No penalties.
- 30 – 44 days prior to tour date:         10% of the total invoice amount with a minimum of  € 250.
- 15 – 29 days prior to tour date:         30% of the total invoice amount with a minimum of  € 350.
-  5 – 14 days prior to tour date:           50% of the total invoice amount with a minimum of  € 500.
- Less than 96 hours:                          100%.

As soon as we receive written confirmation of the cancellation, we will provide a cancellation invoice within 10 days and proceed to the refund if due. In the case some participants arrive late and they miss the tour, activity, transfer or event, no refund will be issued.

5.2 Individual tickets and private tours up to 8 people bought on www.kanpai-tourisme.com or via Kanpai´s tour booking form: if cancellation by the customer takes place more than 7 days before the date and time of tour, no penalty will apply and Kanpai will refund full amount the customer. Bank fees may apply (2%). If the cancellation occurs less than 7 days before the date of the tour, no refund will be made. Kanpai will propose to the customer alternative tours or dates within the limit of tour schedule and guide availabilities.


ARTICLE 6: MODIFICATIONS


Routes and scheduled activities are subject to change at any time due to unforeseen circumstances. If during a tour, Kanpai cannot supply an activity, another equivalent one will be proposed to the customers and Kanpai will eventually support the extra cost of this change.

If modifications concern essential scheduled activities, at the end of the tour, the customer can asked a refund of the activities which haven’t been executed or replaced by Kanpai Tourism. Every effort will be made to operate tours as advertised.

If the group is late, some activities could be shortened or simply cancelled without any refund by Kanpai. If during the tour, the customer asks for extra activities, choose a different itinerary or if they simply want the tour to last longer, Kanpai will charge customers a supplement fully due and paid to the Guide the day of the tour.

 
ARTICLE 7: CANCELLATION BY KANPAI TOURS

7.1 Private group tours of more than 8 people, corporate events, team building activities, as well as coach and minibus transfers: Kanpai reserves the right to cancel the service for unusual or unforeseen circumstances outside the company’s control. If the service is cancelled, you may choose between a full refund or any alternative tour or activity offered by Kanpai.
If the alternative proposal chosen by the customer(s) is of a lower value than that originally booked, then the customer is entitled to a refund of the price difference. If the alternative proposal chosen by the customer(s) is of higher price than that originally chosen, an agreement will be discussed.
Kanpai will inform you of the cancellation by sending you a written confirmation as well as a cancellation invoice. Kanpai won’t be subject to any penalties in case of cancellation by the principal.

7.2 Individual tour tickets purchased on www.kanpai-tourisme.com or via Kanpai´s tour booking form: a minimum of 3 persons is requested to guarantee the departure for an individual tour. In the case that there are less than 3 registered persons, Kanpai can decide to cancel the tour and will contact the customers as early notification as possible to propose them other dates. In case, customers are not flexible, Kanpai will proceed to the total refund of the tickets without penalties for Kanpai.

7.3 Private tours up to 8 people purchased on www.kanpai-tourisme.com or via Kanpai´s tour booking form: in case Kanpai is unable to perform a tour or service for unforeseen circumstances, Kanpai will inform the customer by email or phone as soon as possible. An amicable agreement will be sought in order to agree on a substitute tour or service (example: postponement the tour to a new date, proposal of another itinerary, etc.) In case of refusal or impossibility for the customer to change, Kanpai will refund them immediately and without penalty the sums paid.


ARTICLE 8: RESPONSABILITY

Kanpai’s responsibility is strictly limited by these terms & conditions. Kanpai cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage or loss as a result of « force majeure ». “Force majeure” means unusual and unforeseeable circumstances beyond our control or that our suppliers or partners, the consequences of which could not be foreseen or avoided by us even with the exercise of all due care.


ARTICLE 9: INSURANCE

Customers are liable for all damage and losses caused by their actions during the tours. Luggage and personal possessions remain at all times your own responsibility during tours. Travel insurance is strongly recommended to cover loss of deposit of final monies paid, because of unavoidable cancellation due to illness or other causes, personal baggage loss, medical expenses, etc.
 

ARTICLE 10: COMPLAINTS

If you are in any way dissatisfied with any aspect of a Kanpai Tour, you must write to us outlining the nature of the complaint within 30 days of the end of the tour. French Law will apply to your contract and any disputes arising out of, or in connection with this contract will be settled by the Lyon Court of Justice, France.


ARTICLE 11: PRIVACY POLICY

Kanpai is committed to protecting the privacy and security of any personally identifiable information you provide us. All the documents sent by Kanpai are and stay Kanpai’s propriety. Participants may be photographed for the promotional purposes of Kanpai.
